With a ballot initiative set for the November elections, Montana could be the latest US state to fully legalise cannabis. Click here to read about Montana cannabis law…
Known as the Treasure State because of its wonderfully diverse terrain, Montana could be set to become the latest US state to introduce a legalised cannabis market with a ballot initiative set for the upcoming 2020 elections.
Having first introduced medical marijuana in 2004, Montana residents will decide in November whether to become the latest state to introduce a regulated, adult-use recreational marketplace.
With a recent poll indicating that 54% of Montanans support the full legalisation of cannabis, with 37% opposed, hopes are high (excuse the pun) that Montana could be about to join the eleven states who have already adopted legalised recreational cannabis.
Let’s take a closer look at existing cannabis laws in the state of Montana and what is being proposed in the upcoming November initiative.
Montana Cannabis Law
At present, cannabis is legal for medical purposes but has been illegal for recreational use in Montana since 1929. However, ninety one long years of prohibition could come to a conclusion this Fall with Montana residents set to vote on a legalised recreational market that would establish a regulatory framework for cultivation and sales within the state.
Montana first decided to legalise the use of medical cannabis back in 2004; however, it wasn´t until 2016 that an expansion measure granted state-wide access to patients who required access to medical marijuana.
What is being Proposed for 2020?
Now in 2020, the state looks set to join the 11 other US states including California, Colorado and Nevada who have already introduced a legalised recreational market.
With the vote set for November, Montana residents will vote on two legalisation measures- The first initiative, a statutory change, would establish a system of legal cannabis access for adult-use. A separate constitutional amendment would establish that only those aged 21 and older would be allowed to purchase recreational cannabis.
The proposals dictate that there would be a 20% tax on all sales of recreational marijuana, while the tax on medical cannabis products would be reduced from 2% to 1%.
Revenue from sales of recreational cannabis would be used to fund land, water and wildlife conservation programs, veteran services, health care, substance misuse treatment, local governments that allow cannabis businesses as well as the state general fund.
Can I grow Marijuana in Montana?
At present, cannabis cultivation remains prohibited in the state of Montana. However, that could be all set to change with November´s initiatives.
If voters approve the ballot measures proposed for the upcoming elections, the cultivation of up to four marijuana plants and four seedlings at home would be permitted.
